The pro-illegal immigration leftists and liberal Media are misrepresenting the latest court ruling on DACA (Deferred Action for Childhood Arrivals) as a Trump Defeat, but it is a delay at best. The judge ruled President Trump and his administration simply have to explain their decision to end the program better.
A George W. Bush appointee, Judge John D. Bates' decision does NOT hold that the Trump administration lacks the authority to rescind DACA. Rather, it says the administration's justification for ending the policy is insufficient under the Administrative Procedure Act, which states that courts "shall . . . hold unlawful and set aside agency action . . . found to be . . . arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law." Judge Bates noted a "non-trivial" possibility that the administration would be able to remedy his concerns by providing an alternative rationale, which means the matter could be solved with an in depth explanation.
More clouds of doubt about how San Antonio’s liberal, “progressive” leaders are letting the city become more and more dangerous. Though the city officials deny it, SA acts like a “sanctuary city” from challenging SB-4 in court, to hiring a MALDEF attorney as a special legal advisor, to releasing illegal aliens instead of turning them over to ICE.
In a sad turn of events, a Reagan-appointed judge in the 7th Circuit Court of Appeals in Chicago, upheld a nationwide injunction prohibiting Attorney General Jeff Sessions from requiring cities give immigration agents access to undocumented immigrants in their lock-ups in order to get certain public safety grants. This ruling helps Sanctuary Cities.
U.S. District Judge Harry Leinenweber stated that America's Founding Fathers understood a concentration of power "threatens individual liberty" and established the separation of powers as "a bulwark against such tyranny." I guess he thinks the federal government should continue funding communities that resist immigration law enforcement.
Four months after several people filed complaints with the Texas Attorney General's office against the City of San Antonio and its Police Department for their handling of a human smuggling case, there appears to be no action while the liberal media, led by the SA Express-News, is portraying the illegal aliens as a "victim". Perhaps it's time for citizens to ask questions and demand answers and action.
On or about Dec. 23, 2017, a truck carrying illegal aliens who paid to be smuggled into the U.S., was detained by the SAPD. The truck driver was a smuggler breaking the law, and the illegal aliens had paid to be smuggled. Federal, state, and local cases should have been developed to investigate this smuggling operation.
Liberal San Antonio Express-News reporter Jason Buch who covers immigration and border affairs, wrote a reported about the alleged abuses of illegal alien detainees at Texas facilities. However, the news item was based on a report released last Thursday, March 22, by an immigrant "rights" groups.
